A statute of limitations is a time limit that is placed on a civil action, capping the amount of time that a plaintiff has to bring forth a case against a defendant. Statutes of limitation are designed to protect defendants from actions after an unreasonable amount of time has passed. In Alabama, the statute of limitations is two years from the date of injury. Alabama is one of the few states in the nation that still has a pure contributory negligence system of fault in place. Punitive damages are damages that are designed to punish the defendant for their actions (rather than compensate the victim), and are capped at three times the amount of compensatory damages or $500,000, whichever is greater. In cases where a civil action for physical injury is being pursued, the cap is lifted to three times the amount of compensatory damages or $1,500,000.
