In August 2010, DePuy Orthopedics, a unit of Johnson & Johnson, announced a voluntary recall of their ASR XL Acetabular and ASR Hip Resurfacing Systems. In Feb 2011 the FDA stated that there are “unique risks” for “metal on metal” artificial hips. The possible resulting wear can cause tiny metal ions to dislodge into the surrounding tissue or even possibly the blood stream. The result of which could cause symptoms including:
- Pain in the groin, hip or leg
- Limping or changes in walking ability
- Swelling at or around the hip
History
The Depuy ASR XL Acetabular Hip system is a full hip replacement system, which replaces the ball and socket of your existing hip with an all metal equivalent. It was designed as an option for surgeons in treating patients with extreme and debilitating arthritis as well as other degenerative diseases of the hip joint.
The system was introduced into the US market in 2005 after being approved by the US Food and Drug Administration under the 510K regulatory process as established by Congress. In 2010 the UK National Joint Registry released data showing a higher than normal revision rate for this device, as compared to other manufacturers similar devises, 3 years and 5 years after implantation.
Legal Rights of the Injured
The law in most states provides individuals with legal claims and the right to compensation for injuries they suffer as a result of a medical device that is defective or fails to perform as advertised. Patients may file a personal injury lawsuit seeking compensation for their pain and suffering, medical expenses including the cost of replacement surgery, lost past and future wages and punitive damages.
